Welcome to WritersER! These terms and conditions ("Terms") outline the agreement between WritersER ("the Company") and you ("the Client") regarding the use of our services. By accessing or using our website and engaging our services, you agree to be bound by these Terms. It is important that you read and understand these Terms before proceeding.

Services Provided

WritersER is a doctoral support company dedicated to helping doctoral learners successfully complete their dissertations within a timeframe of 6 months or less. Our experienced team of writers and researchers is committed to providing high-quality support and guidance throughout the dissertation process.

Confidentiality

The Company recognizes that in the course of providing our services, the Client may share sensitive and confidential information with us. This information may include, but is not limited to, methods, processes, formulae, compositions, systems, techniques, inventions, machines, computer programs, research projects, and raw data. The Company agrees to treat all such information as strictly confidential.

Non-Disclosure Agreement

The Company agrees not to disclose any of the confidential information described in Clause 2 to any third party without the express permission of the Client, except as necessary to enforce the rights of either party in the event of a dispute resolution. We will take all reasonable measures to maintain the confidentiality and security of the Client's information.

Post-Service Confidentiality

Upon completion of the Services, the Company will continue to uphold its obligations of confidentiality as outlined in Clause 2. We may fulfill these obligations by either returning all Client materials to the Client or by securely destroying such materials after a period of three (3) months following the completion of the Services.Drafts and Client ResponsibilitiesDrafts provided to the Client are based on the work product materials provided to WritersER and subsequent discussions. The Client is responsible for carefully reviewing these drafts and making any necessary changes to ensure that the final deliverable meets their specific requirements. WritersER will make every effort to meet the Client's expectations, but the ultimate responsibility for the final dissertation lies with the Client.

Intellectual Property

Any intellectual property rights associated with the final deliverables provided by WritersER shall belong to the Client upon completion of the Services. The Client retains full ownership and control over their work, and the Company will not claim any rights to the Client's dissertation or associated materials.

Limitation of Liability

WritersER strives to provide accurate and reliable services; however, we do not guarantee the accuracy, completeness, or timeliness of the information or services provided. The Company shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services or any errors or omissions in the content.

Governing Law and Jurisdiction

These Terms and any disputes arising from the use of our services shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles. Any legal action or proceedings related to these Terms shall be brought exclusively in the courts of [Jurisdiction].

Amendments

WritersER reserves the right to modify or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for any changes. Continued use of our services after any modifications to these Terms constitutes your acceptance of such changes.

Refund Policy

SECTION 1: Service and Program Fees

1.1 Coaching Services: By enrolling in WRITERS ER Educational Consulting Services and paying the Enrollment Fee, you become a client of WritersER. As part of this agreement, WritersER guarantees a rate hold for you.

1.2 Service Fees: By accepting this Agreement, you acknowledge your commitment to pay the agreed-upon amount to WritersER. Please note that all payments made to WritersER are final and non-refundable, except as indicated in the "Notes" section on Page 1.

You are responsible for making timely payments as stated in this contract. Failure to provide a 24-hour notice for late payments will result in a daily late fee of $25 and may cause a delay in delivering your draft(s). Except for any indications listed in the "Notes" section on Page 1, you agree not to request a refund or chargeback for any payments made to WritersER.
Any disputes regarding payments made under this Agreement should be resolved directly between you and WritersER. If a chargeback is initiated, it will be considered a material breach of the Agreement, resulting in the forfeiture of all remaining services that have not been performed. WritersER will have no further obligation to you, except as indicated in the "Notes" section on Page 1.

SECTION 2: Miscellaneous

2.1 Non-transferability:

The rights and obligations under this Agreement are personal to you, and you are not permitted to assign or transfer any of these rights or obligations.

2.2 Integration:

This Agreement, along with any additional terms or policies referenced herein, constitutes the entire Agreement between you and WritersER regarding the Program. It supersedes and replaces any prior proposals, representations, or understandings, whether oral or written, between you and WritersER concerning the Program.

2.3 Governing Law:

This Agreement shall be governed by and interpreted in accordance with the laws of the United States and the state of Texas. Any disputes shall be resolved in the state of Texas.

SECTION 3: 100% Guarantee Terms

3.1 Guarantee of Approval:

The guarantee of approval applies only to packages that include writing support. Editing or coaching only packages do not qualify for this guarantee. By accepting this guarantee, you agree to the following terms:

3.2 Timely Submissions: To be eligible for approval, you must submit your draft(s) to your chair within 48 hours of receiving them from WritersER.

3.3 Iterative Process: Approval can only be achieved through an iterative process, meaning that initial drafts may require revisions to meet the desired outcome.

3.4 Subjective Approval: Final approval is determined solely by your chair/committee and is subjective to their judgment.

3.5 Revision Attempts: You must provide WritersER with a minimum of four revision attempts, based on specific and tracked feedback. All drafts provided by WritersER must be submitted to your chair/committee within 48 hours of receipt. Any feedback received from your chair/committee must be promptly shared with WritersER within 48 hours of receiving it. If a refund request is made, you must provide documentation demonstrating fulfillment of these requirements to WritersER.
